Welcome to GaugeStage. These Terms of Service ("Terms") govern your use of the GaugeStage mobile application, website, and related services (collectively, the "Service") operated by GaugeStage ("Company", "we", "us", or "our").
By accessing or using GaugeStage, you agree to these Terms.
1. Description of Service
GaugeStage provides river gauge data, historical trends, forecasts, and related information for informational purposes only. The Service is intended to assist recreational and commercial users in understanding river conditions.
2. Informational Purposes Only
GaugeStage provides data from third-party and public sources. While we strive for accuracy:
- Data may be delayed, incomplete, or inaccurate
- Conditions on the water may differ from reported values
- Forecasts are estimates and may change
You agree that all information provided by GaugeStage is for informational purposes only and should not be solely relied upon for navigation, safety, or operational decisions.
3. Use at Your Own Risk
Boating, fishing, and river navigation involve inherent risks.
You assume full responsibility for any decisions made based on the information provided by GaugeStage.
You agree that:
- You are responsible for verifying conditions independently
- You will exercise reasonable judgment and caution
- You will comply with all applicable laws and safety practices
4. Limitation of Liability
To the maximum extent permitted by law:
GaugeStage and GaugeStage shall not be liable for any damages, including but not limited to:
- Personal injury or death
- Property damage
- Vessel damage
- Financial loss
- Loss of data or business interruption
arising from:
- Use of or reliance on the Service
- Inaccurate or delayed data
- Service outages or errors
5. Subscription and Billing
5.1 Subscription Plans
GaugeStage offers optional paid subscriptions ("GaugeStage Pro") that unlock additional features.
5.2 Billing
Subscriptions are billed through your Apple App Store or Google Play account.
- Payment is charged at confirmation of purchase
- Subscriptions automatically renew unless canceled before renewal
- Renewal charges occur at the end of each billing period
5.3 Free Trials
If a free trial is offered:
- It will automatically convert to a paid subscription unless canceled before the trial ends
- Any unused portion of the trial is forfeited upon purchase
5.4 Cancellation
You may cancel at any time through your App Store or Google Play account settings.
5.5 Refunds
All billing and refunds are handled by Apple or Google. We do not issue refunds directly.
6. Acceptable Use
You agree not to:
- Use the Service for unlawful purposes
- Attempt to reverse engineer or disrupt the Service
- Interfere with system integrity or security
- Use automated systems to access the Service excessively
7. Intellectual Property
All content, features, and functionality of GaugeStage are owned by GaugeStage and are protected by applicable intellectual property laws.
You may not reproduce, distribute, or create derivative works without permission.
8. Third-Party Services
GaugeStage relies on third-party data providers and platforms (e.g., Apple, Google).
We are not responsible for:
- Third-party data accuracy
- Service interruptions caused by third parties
9. Termination
We may suspend or terminate access to the Service at any time for violation of these Terms or for operational reasons.
10. Disclaimer of Warranties
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
We disclaim all warranties, including:
